President Letter/Carta - Pool
Hello,
There have been reasons to explain some of the current decisions on keeping the pool open.
I have received some questions and have also understood that there are some misconceptions about what is happening around us and how we should relate to it.
First and foremost, as President, I believe that our association must in all situations follow the laws and directives that apply - without exception! Aljamar is/ should be a nice and well-run association.
Furthermore, I believe that we must respect the needs of all members and that everything must be built on a democratic basis based on majority decisions. In other words, in a situation similar to the one we are in, we have to accept that everything may not be as normal and corresponds to our own interests.
I assume that everyone, just as I wish, that this period is transitional, the directives change and that we can soon return to normal and have our pool open as before.
Examples of questions:
Why do we have to have a lifeguard when some other associations have the pool open without a lifeguard?
Such action does not comply with given directive and consequences may arise. That is the reason why serious associations choose to stay closed, or like we are open with a pool guard.
All pools have to comply with article 5.2 health and safety for pools
Capacity 75%, 1.5m between persons inside the pool and in pool area
Cleaning toilets and pool areas at least twice a day and after each person leave the pool
The community can decide on a person to control the capacity if not the owners will have to do it.
All Pools are governed by and must comply with the general technical-sanitary regulations and those specific to Article 5.2. of the Order of the Ministry of Health and Families of the Junta de Andalucía dated June 19, 2020 (BOJA 06/19/2020), these measures are the following:
• Limit of 75% of the capacity of the pool glass and 1.5 meters away.
• 1.5 meters apart, between people who do not live in the same property.
• The community will decide on the need for capacity controllers; shifts or reservations. Otherwise the owners will have to control themselves.
• It must be informed in several visible places of the sanitary measures and capacity.
• There must be pedal bins and an inner bag.
• Regarding cleaning and disinfection of facilities, changing rooms, bathrooms, any element in contact with users, must be done with biocides.
• Establishment of a spatial distribution, by means of signs or marks, to guarantee interpersonal and household distance between non-cohabitants.
Can't we hire our own pool guard?
No, it does not work as it means that we must employ two people for shift work as the week has seven days and everyone must be given time off.
Why and how could we keep the pool open in July / August but then close it? Why was it opened at all?
First of all, I wanted to give everyone the opportunity to prepare for a possible closure. The decision felt obvious as many had planned for the season and it was especially possible as several decisions were made during the year which gave us savings and a surplus in relation to the budget laid by previous management and administrator. As obvious as opening, it was to go out with a question of continued opening based on extra payments. Additional unbudgeted costs were not relevant as we have to safeguard the financial stability that we have now worked up in the association. We now have a solvency and security that was previously lacking.
Why do we have two pool guards?
The most important thing is what we pay for and that is for one pool guard. Why there have been two at occasions is due to the fact that the appointed guard also had his girlfriend on site, which we did not pay for.
2 500 euros / month sounds very expensive?
No, it is not expensive based on the total solution we receive, which also gives the association discharge from liability.
It is almost 250 hours a month which is 8.30 € + Iva per hour
We have previously been promised that the pool will always be kept open during the season?
Which is something i can’t comment on other than that is why the association has voted as a collective on what to do.
We are in the middle of a pandemic.
Why can members who do not use the pool be involved and decide how it should be kept open?
Personally, I can not make the assessment of who uses and does not use the pool. Otherwise, from a democratic point of view, it is a given to me that all members who participate and pay must also be given the opportunity to influence.

Las razones por las que se ha decidido mantener la piscina abierta se deben explicar.
He recibido consultas por parte de propietarios y entiendo que hayan habido algunos malentendidos sobre lo que ocurre y como debemos afrontar la nueva realidad.
Primero y principal, como Presidente, creo que nuestra comunidad siempre debe respetar la legalidad y las directivas aplicables sin excepción alguna. Aljamar es y debe ser una bonita comunidad bien dirigida. Además, creo que debemos respetar las necesidades de todos y cada uno de los propietarios tomando decisiones de forma democrática basadas siempre en las mayorías. Tenemos que aceptar que la situación actual no es una situación que interese a nadie. Espero y deseo que esto sea un periodo transitorio que pase lo antes posible, y que todo vuelva a la normalidad para que podamos abrir la piscina como siempre hemos hecho.
Preguntas que se nos han planteado:
¿Por qué necesitamos un vigilante cuando hay otras comunidades que han abierto sus piscinas sin vigilante?
Dicha acción no cumple con la normativa y las recomendaciones, y puede tener sus consecuencias. Es por esto que muchas comunidades serias han decidido no abrir sus piscinas, o como la nuestra que hemos abierto con una persona que vigile el aforo máximo y lleve a cabo las desinfecciones.
Todas las Piscinas están regidas y deben cumplir las normas generales técnico-sanitarias y las específicas del Artículo 5.2. de la Orden de la Consejería de Salud y Familias de la Junta de Andalucía con fecha 19 de junio de 2020 (BOJA 19/06/2020), dichas medidas son las siguientes:
• Límite del 75% del aforo del vaso de la piscina y 1.5 metros de distancia.
• En el resto, 1.5 metros de distancia, entre personas que no viven en el mismo inmueble.
• La comunidad decidirá sobre la necesidad de controladores de aforo; turnos o reservas. En caso contrario los propietarios deberán auto controlarse.
• Debe informarse en varios lugares visibles de las medidas sanitarias y de aforo.
• Debe disponerse de papeleras a pedal y bolsa interior.
• En cuanto a limpieza y desinfección de instalaciones, vestuarios, baños, cualquier elemento en contacto con los usuarios, debe hacerse con los biocidas.
• Establecimiento de una distribución espacial, mediante señales o marcas, para garantizar la distancia interpersonal y de enseres entre no convivientes.
¿Puede la comunidad contratar un vigilante para controlar el aforo y realizar las desinfecciones?
No, porque tendríamos que contratar a dos personas, la semana tiene 7 días y un trabajador no puede trabajar una semana sin descanso.
¿Por qué y cómo hemos podido abrir en julio y agosto, y a continuación cerrarla?; ¿Por qué se ha abierto la piscina?
Primero, se ha querido dar la oportunidad a todos en caso de que tuviésemos que prepararnos para un nuevo confinamiento. Muchos propietarios tenían planeada la temporada y ha sido posible abrir la piscina pese al coste que esto supone, ya que durante el año se han tomado decisiones que nos han permitido un ahorro en las cuentas generando un superávit, es por esto que se ha podido hacer frente a un gasto, el de abrir la piscina, que no estaba presupuestado. Nuestra comunidad tiene ahora una solvencia y seguridad que antes no había.
¿Por qué hay dos vigilantes en la piscina?
Lo más importante es saber que solo estamos pagando por un vigilante. Si hay dos es porque en ocasiones la novia del vigilante está con él.
¿2500 Euros/ Mensuales suena muy caro?
No es caro por el servicio que recibimos, la empresa además es la única responsable de cualquier daño que se pueda producir por inobservancia o negligencia en sus funciones.
Son 250 horas mensuales lo que equivale a 8,30€ más IVA la hora.
¿Se acordó que la piscina estaría siempre abierta durante la temporada de verano?
Es algo sobre lo que no haré comentarios y solo diré que la comunidad ha votado que debemos hacer en relación a si mantenemos la piscina abierta o no.
Estamos inmerso en una pandemia de inciertos resultados.
¿Por qué aquellos propietarios que no utilizan la piscina, pueden decidir si se abre?
Todo propietario tiene derecho a decidir con su voto si en las actuales circunstancias mantenemos la piscina abierta o se cierra.
